TERMS & CONDITIONS of hire

Any agreement,
whether written or verbal, for the provision of Fire
Engine limousine hire shall be between Party Hire
Brigade hereafter known as "the Company", and the person
signing the booking form who shall hereinafter be known
as "the Hirer". The Hirer accepts responsibility by himself/herself for every person in his or her party, agrees to the conditions of hire as shown below, and shall be bound to advise their party of the relevant terms and conditions of the hire. The Hirer signing the booking form must be at least 18 years of age although bookings may be accepted at the Company’s absolute discretion for parties under the age of 18 subject to the parent or guardian of a member of the party signing the booking form as the Hirer and, in doing so, accepting the responsibilities of the Hirer for the purposes of the agreement. Where the Hirer is a business then that business or company shall assume the responsibilities of the Hirer as detailed in these terms and conditions. By booking with the Company, you are deemed to have accepted the following Terms and Conditions and agree to be bound by them. It is understood that those persons booking by telephone are automatically bound by these conditions and that the Hirer initiating the booking is responsible for making all members of the party aware of these conditions. Your contract will be with the Company. A legally binding contract between you and the Company is only formed when we confirm to you in writing (either by e-mail, text or post) that your booking has been accepted. The Company will be entitled, at its absolute discretion, to refuse any booking placed. The Hirer undertakes that all details provided to the Company for the purpose of booking will be correct and that the cheque book account and/or credit card you are using contains sufficient funds to cover the cost of hire. The price as agreed if booked using a credit card / debit card through Pay-Pal may include an administration and /or booking fee. Bookings & Cancellations - All bookings must be reserved in advance and a non-refundable deposit of £50 paid upon reservation. No reservation can be confirmed until a completed booking form has been returned and the deposit has been paid. The outstanding balance due must be paid 14 days before the start of the hire - payment in cash or by credit/debit card can be made on our web site for hire but will include a booking admin fee. If payment of the balance is to be made by cheque it must be received by the Company not less than 14 days before the date of hire. Once a reservation has been confirmed and the deposit received, the hire fee will not be subject to alteration unless the details of the original booking are changed. The Company will always make every effort to facilitate any alterations or extra requests to the booking but it cannot guarantee to meet such requests. In the event that the Company is able to meet these requests, any extra charges resulting from this must be paid by cash to the chauffeur at the commencement of the hire (or when the request is made if this is during the course of the hire). Any additional charges due (e.g. extension to hire time, damage fees etc) must be paid in cash.
CHEQUES WILL NOT BE ACCEPTED ON THE DAY

Whilst the Company undertakes to ensure that its
vehicle is properly serviced and maintained it will not
accept any responsibility for delay or cancellation as a
result of any breakdown or accident, howsoever caused.
In the unlikely event of a breakdown or accident every
effort will be made for an immediate repair so that the
journey can continue, or the party will be transferred
to another vehicle. 3.
In the event of a breakdown or accident to the vehicle
before the date of hire, the Company will make every
effort to ensure that the vehicle is repaired or an
alternative vehicle made available. If this is not
acceptable to the Hirer, or if the Company is unable to
fulfil this condition, the Company will refund any
monies paid for the hire. The Company reserves the right
at any time to change, replace or renew the vehicle
booked. The Hirer expressly accepts that the
entertainment system is provided as a courtesy and its
use and/or availability does not form part of the hire.
The Company will endeavour to ensure that all equipment
is in working order but in the event that any equipment
fitted to the engine malfunctions prior to or during the
hire, the Company accepts no liability and no
compensation or refund shall be provided in such
instances. 4. Behaviour which could give rise to damage to the vehicle, cause offence to other persons or endanger the safety of other passengers will not be tolerated in any form. This includes, but is not restricted to; sitting on the exterior of the vehicle, climbing the rear ladders, hanging out of the windows, shouting abuse to other road users or pedestrians out of the window, rudeness or intolerance with the chauffeur, misuse of the equipment, fixtures or consumables within the vehicle and wilful damage to the interior generally. Such behaviour may, at the sole discretion of the chauffeur, result in the immediate termination of the hire without compensation.

The Hirer shall be fully responsible and liable for any
damage caused to the vehicle or its contents (including
incitement to any third party that results in damage to
the vehicle) or for any theft/removal of Company
property (e.g. drinking glasses, CDs etc) from the
vehicle by any of the members of his or her party. The
Hirer agrees to be liable for the total cost of any
repair - such repair to be determined by the Company
together with a fixed daily rate (to be determined by
the Company) whilst the vehicle is out of commission.
Any persons seen to cause damage to the fire engine
limousine will be charged accordingly and may be driven
to the nearest Police station without warning from the
driver. 6. Unless otherwise instructed by the passenger, routes travelled will be at the chauffeur’s discretion, in accordance with road, traffic and weather conditions, whether the route is the shortest or not. Whilst the chauffeur will endeavour to pick up and set down passengers at requested points this may not always be possible due to the length, width, and weight of the vehicle, surface conditions, private property laws, safety issues or road traffic laws and regulations. In the event that vehicular access to the requested address is not possible every effort will be made to bring the vehicle as close as possible to the requested address. The chauffeur is the sole arbiter as to whether a vehicle can be taken to the requested location and his/her decision is final.

IN ANY ONE TRIP THE MAXIMUM NUMBER OF PASSENGERS THAT
WILL BE CARRIED IS EIGHT, IN ADDITION TO THE CHAUFFEUR.
The limit of eight passengers is a legal restriction as
we are licensed as a private hire vehicle, and the
Company will not carry more than this under any
circumstances as it would invalidate our ‘Hire & Reward’
insurance cover.
One adult must
accompany children's parties where any child is under
the age of 8 years. The adult is responsible for
ensuring that the children wear the seat belts provided,
and behave in a sensible manner and do not become a
danger to the driver or themselves. Each hours hire
means for one continuous hour, not two or more separate
periods, but this may be relaxed at the discretion of
the Company. 10.
The Hirer expressly accepts that except in cases of an
emergency, only the Chauffeur may open and close doors.
This is a safety precaution to minimise the risk of
accidents to the passengers and damage to the vehicle.
The Hirer accepts all responsibility for any damage to
the vehicle and/or any third party as a result of the
Hirer or Hirer’s party failing to adhere to this
condition. 14.
Should a passenger be ill in the fire engine, and vomit
makes contact with any part of the vehicle, the journey
will be stopped and that person will be required to pay
£100 before the trip will continue. This is to cover the
costs of the valeting of the vehicle to remove any odour.
In the event that the passenger will not or cannot pay,
it shall become the responsibility of the Hirer to make
this payment. If feeling ill the chauffeur on request
will stop as soon as it is safe to do so.
22.
These terms and conditions are for the protection of
both the Hirer and the Company. If you do have any
claim or complaint, you should first seek redress from
the Company. The laws of England shall govern the
contract between the Hirer and said Company and we
hereby submit to the exclusive jurisdiction of English
courts.
Individual
amendments to these terms and conditions must be
approved by the directors of the Company. |
